This Privacy Policy governs the processing of personal data by Noon BV, trading under the name “The NOON Agency”, with its registered office at Karmenhoekstraat 14, 9850 Hansbeke, Belgium, enterprise number 1009.000.235 and VAT number BE 1009.000.235.

Unless otherwise stated, Noon BV is the data controller for the personal data covered by this Privacy Policy.

1. What personal data do we process?

When you contact us, request a quotation, enter into an agreement or work with us, we may process information such as your name, contact details, position, company details, communications, project information, and billing and payment details.

When you use our website, technical data may also be processed, including your IP address, browser and device information, pages visited and the date and time of your visit.

We may receive personal data from clients, suppliers, business partners, social media platforms or publicly available professional sources. When we do not obtain your personal data directly from you, we will inform you within the period required by law, unless an exception applies.

Certain information is necessary to process a request, perform an agreement, issue an invoice or comply with our legal obligations. If you do not provide this information, we may be unable to provide our services.

2. Why do we process personal data?

We process personal data to answer enquiries, prepare and follow up quotations, manage client and supplier relationships, and plan and provide marketing, communication, operations, project and event services.

We may also process personal data for invoicing and accounting, security, fraud prevention, handling complaints and disputes, collecting outstanding payments and complying with legal obligations.

Depending on the purpose, we rely on your consent, steps taken before entering into or the performance of an agreement, a legal obligation or our legitimate interest in conducting our activities properly and securely.

We request your consent for newsletters, non-essential cookies and electronic marketing, unless a statutory exception for existing clients applies. You can always unsubscribe easily and free of charge.

Where Noon BV processes personal data solely on a client’s instructions, for example in connection with a campaign, project or event, Noon BV acts as a data processor and the client remains the data controller. Such processing is governed by a data processing agreement.

3. With whom do we share personal data?

We do not sell your personal data.

We may share personal data with service providers that are necessary for our activities, including providers of website hosting, cloud storage, email, project software, accounting, payment, marketing, communication, printing, audiovisual production and event support services.

These parties only receive the personal data they need. Where they process personal data solely on our behalf, we enter into a data processing agreement with them.

We may also share personal data with clients, suppliers, freelancers, venues, public authorities, professional advisers or other authorised parties where this is necessary for an assignment, required by law or necessary to protect our rights.

Some service providers may process personal data outside the European Economic Area. In that case, we use a legally recognised transfer mechanism, such as an adequacy decision, the EU–U.S. Data Privacy Framework or approved Standard Contractual Clauses. 5. Retention periods

We do not retain personal data for longer than necessary.

General enquiries and quotations that do not lead to a collaboration are generally retained for no longer than 24 months after the last contact. Client, project and contract information is retained for the duration of the collaboration and subsequently for the applicable statutory limitation and retention periods.

Accounting and tax records are generally retained for ten years. Marketing information is retained until you withdraw your consent or object, or for no longer than two years after the last meaningful contact. Cookie retention periods are stated in the cookie settings.

Personal data that we process on behalf of a client is retained in accordance with our arrangements with that client.

6. Security

We implement appropriate technical and organisational measures to protect personal data against loss, misuse, alteration, unauthorised access and unauthorised disclosure.

Where a personal data breach is likely to result in a risk to the affected individuals, we notify the Belgian Data Protection Authority within the period required by law. Where the breach is likely to result in a high risk, we also inform the affected individuals, unless a statutory exception applies.

7. Your rights

Subject to the conditions of the GDPR, you have the right to access, correct or erase your personal data, restrict its processing and receive or transfer certain personal data.

You may object to processing based on a legitimate interest. You may always object to direct marketing without having to provide a reason.

Where processing is based on consent, you may withdraw your consent at any time. This does not affect the lawfulness of processing carried out before the withdrawal.

We do not make decisions based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you.

Where Noon BV acts solely as a data processor, we will forward your request to the relevant client or assist that client in handling it.
